2nd is more likely but the seller has good reputation and it seams odd for a scam.
Maybe ask the seller what happened and ask for a refund? Their reaction should be telling.

What could be done (but is not worth the effort). If traded back and it becomes lvl 89 again, put it on a lvl 90 char and see if they can equip it: this would verify UI bug vs item bug.
You could also analyze the screenshot to see if it was faked. I made a quick visual check if the numbers are slightly off and how the background around the numbers look. Nothing suspicious on first sight but fake images often have clues in the lower bits of the colors.

It was a Necro - I Asked ChatGPT about this and it said it wasn't the issue (but it could be wrong).

Swapping character class and checking would at least eliminate one possibility, and I wouldn't go with everything an AI tells you. I've posed the exact same question to different AIs and got conflicting answers.

This is the cause. According to the screenshot provided, it appears the seller's mule was a necro. Probably took the screenshot with the same mule too. Crafted items that roll with certain class specific charges will have an increased level requirement when viewed with a class that doesn't have the charges as an Oskill. Necro viewing item with Bone Spear charges vs sorceress viewing the item.
You will see this most commonly with necro and amazon Charge skills.
This is a fairly obscure issue so I'd bet on the seller being completely unaware and having no Malice in the trade.
I'm willing to accept Tokens, Keys, Perfect Gems, and certain minor runes (this changes regularly so please ask but usually Eth, Nef, Sol, Ral, Hel, Lem, Pul, Um) in lieu of my asking price when my "looking for" price is a rune.
