You can justify anything, it's made up magic. Having durability loss doesn't make sense to me ...for a skill named "echoing" strike which literally is a Spell.
U take your weapon's damage and project sound outwards and it bounces back to you, similiar to War Cry and..might i add - Shock Wave.
There never is any physical interaction between the weapon (that is FLOATING) ever touching whatever is targeted, only the echoes branch out and return.

Soft points won't do to improve the demon count.
Bind Demon doesn't affect the available count but does affect the type of demon you can bind.
If you're fine binding some random trash mob, you don't need to spend hard points. Soft will do. And if you can push past 20 with soft points alone, you'll still get all of the affixes on that trash mob, including the aura, making it still a very solid pick.
If however you want to bind a champion, unique or super unique, you will need actual hard points in Bind Demon as atari already pointed out above.
I was refering to the scenario where you already have a bound super unique like Hephasto and just want to keep it, not to bind a new demon after the patch. But I guess I got my answer, so thanks.

When the new patch come online, if I don't have enough skill levels (counting the required hard and/or soft depending of the skill) to have my current bound demon, will I keep it or lose it?
(for exemple if I had bind a super unique and currently have only Bind Demon L1 - 1 point no equipment

And given tha Bind Demon dies when you respec (even with some +1 Bind Demon item), there is nothing you can do to try to save you Bind Demon if you currently don't have enough hard points...

You can get a solid demon that way, yes. I just snagged a cursed trash vile lancer on the PTR most of the time. As for it soloing ubers..we'll see..they did readjust the health Cap again apparently so..maybe
